$100,000 awarded to our client from a homeowner’s insurance claim. Our client was a pedestrian walking with a friend down a street without sidewalks. As they were walking, they noticed a vehicle approaching them from behind and moved off the road for safety. That’s when our client stepped in a hole on the neighboring property that had been dug out for a sprinkler repair, but it had not been filled back in. In fact, the dirt from the hole was on the roadway. Due to lack of street lighting in the area and leaves which had blown into the hole, the hazard was not visible. Our client was pitched forward and fell very hard breaking her shoulder/humerus.
